GENERAL TERMS AND CONDITIONS
- Definitions
“Client” means the individual, company, or entity that makes the reservation, accepts these Terms and Conditions, and is responsible for payment. Where the Client is an entity, any individual making the reservation or accepting these Terms on its behalf represents that they have the authority to bind the Client.
“Guest” means the individual(s) occupying the suite, whether or not they are the Client.
Where applicable, the Client and Guest are jointly and severally responsible for obligations under this agreement.
- Accommodation & Services
DelSuites agrees to provide temporary furnished accommodation for the agreed reservation term. Accommodation may include, unless otherwise specified: furnished living space, utilities, high‑speed internet, cable and/or streaming television, local telephone service (some locations), and bi‑weekly housekeeping.
- Nature and Use of Premises
The suite is provided for temporary residential accommodation only. The Guest agrees not to use the suite for business, commercial, event, or illegal purposes, and not to host unauthorized gatherings or parties. Subletting or listing the suite on any rental or home‑sharing platform is strictly prohibited.
- Occupancy
Only persons registered to the reservation may occupy the suite overnight unless DelSuites provides prior written authorization. Assignment or transfer of occupancy is not permitted. The Client and Guest are jointly and severally responsible for the conduct and actions of all occupants, visitors, and invitees admitted to the suite during the reservation.
- Arrival and Departure
Arrival and departure times are as noted on the reservation confirmation. Requests for early arrival or late departure must be approved in advance and may be subject to additional charges. If the Guest fails to vacate the suite by the agreed departure date and time without DelSuites’ prior written consent, the continued occupancy shall be unauthorized. DelSuites may charge for each night or partial night the suite remains occupied at the applicable nightly rate, together with any additional costs reasonably incurred as a result of the overstay, including housekeeping, operational disruption, or rescheduling costs, plus applicable taxes, without prejudice to any other rights or remedies available to DelSuites under this agreement or at law. DelSuites also reserves the right to take reasonable steps to recover possession of the suite if it is not vacated as required.
- Inspections, Damages & Charges
Inspections are conducted before arrival and after departure. The Client and/or Guest are responsible for damages beyond normal wear and tear. DelSuites will make reasonable efforts to remedy damages at the lowest practicable cost. Chargeable items may include, but are not limited to:
- Damage to floors, walls, fixtures, appliances, furniture or contents
- Excessive cleaning requirements
- Parking space damage
- Odours or contamination preventing re‑rental (e.g., smoking, pets)
- Lost revenue where repairs, remediation, or additional cleaning attributable to the Client’s or Guest’s actions results in the suite being unavailable for re‑rental
- Lost or unreturned keys, fobs, access cards or remotes
- Removal of suite contents
- Guest Concerns
Guests are required to notify DelSuites as soon as reasonably practicable after check‑in of any issue that materially affects the condition of the suite or the stay, including cleanliness concerns, maintenance issues, or in‑suite malfunctions. DelSuites will make reasonable efforts to investigate and address properly reported concerns within a reasonable period. Failure to notify DelSuites of a material issue within a reasonable time after discovery may limit DelSuites’ ability to remedy the issue.
- Right of Entry
DelSuites may enter the suite at reasonable times for housekeeping, inspections, maintenance, repairs, safety concerns, or operational requirements, with reasonable notice where practicable or immediately in the event of an emergency.
- Guest Responsibilities & Building Rules
The Guest agrees to use the suite and any building common or amenity areas in a reasonable and responsible manner and to comply with all applicable building, condominium corporation, and property rules, by‑laws, declarations, and policies (collectively, the “Building Rules”). Without limiting the generality of the foregoing, the Guest agrees to:
- Maintain the suite in a clean and sanitary condition, including regular removal of garbage and waste
- Practice reasonable use of utilities and promptly report maintenance, damage, or safety issues to DelSuites
- Avoid actions or omissions that may create safety risks, cause damage, result in infestation, interfere with building operations, or disturb other occupants or residents
- Use the suite and building common areas solely for ordinary residential purposes and in a manner consistent with applicable Building Rules.
Prohibited conduct includes, without limitation, tampering with safety or security equipment; blocking or misusing plumbing fixtures; improper disposal of garbage or debris; hanging or placing items on balconies, windows, or exterior areas; hosting unauthorized gatherings or parties; or engaging in any conduct that results in warnings, fines, penalties, charges, or enforcement action by a condominium corporation or building authority. Any fine, penalty, charge, cost, special assessment, or other amount imposed on or charged to DelSuites by a condominium corporation, building authority, or property manager as a result of the Guest’s conduct or breach of the Building Rules shall be the responsibility of the Client and/or Guest and may be charged to the payment method on file without further notice. Where negligence, misuse, or inaction results in additional costs, including cleaning, repairs, pest control, remediation, administrative charges, or building fines, the Client and/or Guest may be held liable for such costs. Repeated or serious breaches may constitute grounds for immediate termination of the reservation in accordance with these Terms and Conditions.
- Alterations
The Client and Guest shall not make, permit, or request any alterations, installations, removals, or modifications to the suite or its fixtures without the prior written consent of DelSuites. This includes, without limitation, the installation or use of any hidden or exposed recording, surveillance, or monitoring devices; the installation of plumbing devices or attachments (including bidet hoses or similar aids); or the installation of additional locks, fasteners, or fixtures of any kind. Any unauthorized alterations or installations may result in charges for removal, restoration, or resulting damage, and may constitute grounds for termination of the reservation in accordance with these Terms and Conditions.
- Housekeeping
Housekeeping is provided on a bi‑weekly basis unless otherwise specified. DelSuites reserves the right to adjust housekeeping services based on the condition of the suite and will notify the Guest of any service limitations.
- Pets
Pets are not permitted unless approved in writing by DelSuites and subject to a signed Pet Agreement. Applicable fees apply. Failure to disclose pets may result in additional charges and possible termination of the reservation.
- Smoking
Smoking, vaping, or burning of any substance is strictly prohibited in all suites and related areas. A minimum charge of $1,000 will apply for violations, plus any additional restoration costs.
- Payment Terms & Methods
The Client agrees to pay all charges associated with the reservation, including accommodation, extensions, damages, incidentals, service fees, and applicable taxes. Incidental charges may include but are not limited to: long‑distance or pay‑per‑use telephone charges (where available); additional or pay‑per‑use television services; charges for extra items or services ordered by the Guest; and any applicable administrative fees where such services are arranged through DelSuites.
Unless otherwise agreed in writing:
- Payment for the first thirty (30) nights is charged fourteen (14) days prior to arrival, or at booking if arrival is within fourteen (14) days
- Subsequent thirty‑night billing periods are due seven (7) days prior to commencement
- Outstanding balances may be charged to the payment method on file
- A valid credit card authorization or security deposit must be maintained on file for the duration of the reservation
Accepted payment methods (subject to change) include credit cards, pre‑authorized debit (Canadian institutions only), Interac e‑Transfers, electronic funds transfers, and certified cheques. For reservations relating to suites located in Ontario, credit card payments are subject to a 2.4% processing fee, which is non‑refundable, including in the event of cancellation or early departure. For reservations relating to suites located in Québec, no credit card processing fee applies.
Any amounts not paid when due may be subject to late payment charges and interest, calculated from the due date until paid, in accordance with applicable law.
- Minimum Stay, Changes & Cancellations
The minimum reservation period for all DelSuites accommodations is thirty (30) consecutive nights for suites located in Ontario, and thirty‑two (32) consecutive nights for suites located in Québec. The applicable minimum stay is determined by the province in which the suite is located. This minimum stay is a fundamental condition of each reservation and of the Guest’s right to occupy the suite. Early departure prior to completion of the applicable minimum stay requirement does not shorten or waive the minimum stay obligation. Where a Guest vacates the suite or the reservation is terminated for any reason before the minimum stay has been completed, the Client shall remain liable for accommodation fees and applicable charges for the full minimum stay period.
After the minimum stay has been satisfied, early departure requires fourteen (14) days’ written notice to avoid penalty.
Cancellations prior to arrival require fourteen (14) days’ written notice to avoid a $500 plus applicable tax cancellation fee.
Extensions are subject to availability and may be repriced. If an extension is approved by DelSuites, all terms and conditions of this Agreement shall continue to apply to the extended stay, except as may be expressly amended in writing.
- Internet & Technology
Internet service is provided by third‑party providers and is outside DelSuites’ control. DelSuites is not responsible for outages or interruptions. Use of internet services and provided equipment is at the Client’s and Guest’s own risk, and users are responsible for securing their own devices.
- Insurance & Liability
DelSuites’ insurance does not cover the personal belongings of Clients or Guests. Clients and Guests are solely responsible for safeguarding their property and are encouraged to maintain appropriate personal and/or corporate insurance coverage for loss, damage, or liability.
To the maximum extent permitted by law, and except where DelSuites has failed to meet its legal obligations, DelSuites shall not be liable for any personal injury, death, loss, theft, or damage to persons or property arising out of or in connection with the reservation, the Guest’s occupancy of the suite, or the use of the suite, the building, parking facilities, or any common or amenity areas.
The Guest acknowledges that the suite is located within a residential building and that the use of the suite, building, parking areas, elevators, and any common or amenity spaces involves ordinary and inherent risks associated with residential properties, many of which are outside of DelSuites’ ownership, operation, or direct control. The Guest voluntarily assumes responsibility for such risks and agrees to use these areas and facilities at their own discretion.
DelSuites does not guarantee and shall not be responsible for the condition, availability, operation, or suitability of any building amenities, common areas, security features, or services that are not owned, operated, or directly controlled by DelSuites, including those managed by third parties or condominium corporations.
Nothing in these Terms and Conditions shall exclude or limit any liability that cannot be excluded or limited under applicable law.
- Furniture & Contents
All furniture, fixtures, and contents within the suite are provided for the Guest’s use at the Guest’s own risk. The Client and Guest agree to use all furniture and contents in a reasonable and responsible manner and in accordance with these Terms and Conditions. The Client and Guest agree to indemnify and hold DelSuites harmless from any claims, loss, damage, or expense arising from the misuse, damage, or improper use of any furniture, fixtures, or contents of the suite.
- Parking (Where Applicable)
Parking is subject to availability and building rules. Vehicles are parked at the Guest’s own risk. DelSuites is not responsible for loss, damage, fines, towing, or changes to parking allocation.
- Storage of Personal Property
DelSuites cannot guarantee storage space for the Client’s or Guest’s furniture, bicycles, or other large items. Storage of bicycles is not permitted in automobile parking spaces. The Client and Guest agree to make alternate arrangements for the storage of such items where required.
- Abandoned Property
Personal items left behind after departure may be deemed abandoned. DelSuites may remove, store, or dispose of such items in its discretion and shall not be responsible for loss or damage. Any reasonable costs incurred may be charged to the Client.
- Relocation or Cancellation by DelSuites
In rare or unforeseen circumstances, including suite sale, owner withdrawal, or events beyond DelSuites’ control, DelSuites may be required to cancel or relocate a reservation. DelSuites will make reasonable efforts to offer comparable accommodations or refund prepaid amounts. Any refund shall constitute full and final settlement of liability.
- Termination
DelSuites may terminate a reservation immediately, without prior notice, where the Client or Guest breaches these Terms and Conditions, including for non‑payment, illegal activity, or conduct that poses a risk to the safety, security, or reasonable enjoyment of the suite, the property, or other persons. Grounds for termination include, but are not limited to: harassment, threats, intimidation, violence, discriminatory or abusive behaviour directed toward DelSuites staff, other guests, building residents, or visitors; repeated or serious breaches of the Guest Responsibilities and Building Rules set out in Clause 9; or any conduct that results in fines, enforcement action, or material complaints from a condominium corporation or building authority. In the event of termination, DelSuites shall have no obligation to provide alternative accommodation, and the Client shall remain liable for all applicable charges in accordance with these Terms and Conditions, including any outstanding accommodation fees, damages, fines, or costs arising from the breach.
- Nature of Agreement – Temporary Accommodation; Licence to Occupy
This agreement creates a personal, revocable authorization to occupy the suite for the confirmed reservation period and does not create a lease, tenancy, or landlord-tenant relationship under the Residential Tenancies Act, 2006 (Ontario), the Civil Code of Québec, or otherwise. The accommodation is intended to fall within the exemption in section 5(a) of the Residential Tenancies Act, 2006 for short-term or temporary accommodation, and any corresponding exemption in other jurisdictions. Neither the Client nor the Guest acquires any tenancy, possessory, or other real property interest in the suite, regardless of length of stay or extensions, and DelSuites retains possession and control at all times. The Client and Guest each represent and warrant that they maintain a principal residence elsewhere, will not use the suite as their principal residence, and are staying for a temporary purpose (such as relocation, business travel, medical treatment, transitional housing, or vacation). DelSuites relies on these representations as an essential condition for entering into the present agreement; any material misrepresentation is a breach and grounds for immediate termination under Clause 23.
- Privacy
By making a reservation and/or occupying the suite, the Client and Guest acknowledge and agree that DelSuites may collect, use, store, and disclose personal information as reasonably required to process the reservation, administer the stay, provide services, comply with legal obligations, and otherwise operate its business, in accordance with the DelSuites Privacy Policy, as amended from time to time, available at: https://www.delsuites.com/privacy.php.
- Non‑Discrimination
DelSuites is committed to providing accommodation in a manner that complies with applicable human rights legislation. DelSuites does not discriminate in the provision of accommodation on any grounds protected by law, and all reservation decisions are made in accordance with applicable legal requirements.
- Governing Agreement
Certain reservations may be made by or on behalf of a corporate entity, relocation company, travel agency, or other organization. Unless and until a separate written agreement is executed between DelSuites and such entity, these Terms and Conditions shall govern the reservation. Where DelSuites and a corporate entity enter into a separate service agreement, corporate agreement, or similar written agreement executed by DelSuites in respect of a reservation, the terms of such agreement shall apply only to the extent expressly stated therein, and shall prevail over these Terms and Conditions solely in the event of an inconsistency. In the event of a conflict between these Terms and Conditions and any third‑party booking platform or intermediary terms, these Terms and Conditions shall govern unless otherwise expressly agreed to in writing by DelSuites.
- Governing Law and Jurisdiction
These Terms and Conditions and any reservation or dispute arising out of or relating to them shall be governed by and construed in accordance with the laws of the Province of Québec and the federal laws of Canada applicable therein, without regard to conflict‑of‑laws principles. The Client and Guest irrevocably attorn to the exclusive jurisdiction of the courts of the Province of Québec, district of Montréal, for the resolution of any dispute arising from or in connection with these Terms and Conditions or the reservation. Notwithstanding the foregoing, DelSuites reserves the right to seek injunctive, possessory, or equitable relief, or to enforce any monetary judgment, in any court of competent jurisdiction where the Client, Guest, or their assets may be located.
- Language
These Terms and Conditions are available in both English and French. For accommodations located in Québec, the French version shall prevail in the event of any inconsistency or discrepancy, unless the Client has expressly confirmed their intention to be bound by the English version. For accommodations located outside of Québec, the English version shall prevail.
By completing this booking, the Client (and any occupying Guest) acknowledges and agrees to these Terms and Conditions, including that the reservation is for temporary accommodation only and does not create a lease or tenancy.
